Agreeing to these terms

These Terms of Service (“Terms”) are an agreement between you and CREATEWOKS (“we”, “us”) about your use of the CREATEWOKS website and app (the “Service”). By creating an account or using the Service you agree to these Terms, the Privacy Policy, the Cookie Policy and the Acceptable Use Policy and the Refund and Cancellation Policy. If you do not agree, please do not use the Service.

Who can use CREATEWOKS

You must be at least 18 years old and able to enter into a binding agreement. If you use the Service for a business, you confirm you have authority to bind that business.

Your account

• Give true and current information, including your age and country.
• Keep your password private. You are responsible for everything done through your account.
• One account is for one person. Do not share it or sell access to it.
• Tell us at once if you think someone else has used your account.

What the Service does

CREATEWOKS helps you plan and make videos: it suggests ideas, writes and fact-checks scripts, prepares image prompts, creates narration, lets you edit a video, exports it on your device, writes cover and post text, and keeps a content calendar. We keep improving it, so features may change, move or end. We will try to give notice of changes that significantly reduce what you can do.

AI-generated content

Much of what the Service produces is made by artificial intelligence. It can be wrong, incomplete, out of date or similar to what others receive. The fact-check feature is a helpful guide, not a guarantee.

• You must read, check and edit anything before you publish it.
• You are responsible for the facts, claims and opinions in your videos.
• Some platforms require you to label AI-generated or altered content. You are responsible for following their rules.
• Trend and ranking suggestions are ideas, not promises about views, rankings or income.
• Pictures you make with other tools and bring into CREATEWOKS are governed by the terms of those tools. You confirm you are allowed to use them.

Your content and who owns it

You keep ownership of the videos, scripts, pictures and other material you make or bring into the Service (“Your Content”), to the extent the law and the terms of the tools you used allow. We do not claim ownership of Your Content.

You give us a limited permission to process the text you submit so we can deliver the features you ask for, including sending it to our AI providers. You are responsible for having the right to use everything you add, including images, music and words.

Because AI output is not always protected by copyright, we cannot promise that you will hold exclusive rights in it.

Your work lives on your device

Your projects, pictures and voice recordings are stored in your browser on your device, not on our servers. If you clear your browser data, change devices or your device fails, they may be lost and we cannot recover them. Export and back up videos you want to keep. We are not responsible for loss of data stored on your device.

Plans, payments and quotas

CREATEWOKS is sold as monthly plans called Starter, Solo, Crew and Studio. There is no free plan. The price in naira, the video minutes, the longest video and the art styles included in each plan are shown on the Plan and billing page and on our home page before you pay.

• Billing period. A plan lasts one month from the day you pay.
• Automatic renewal. If you choose a plan with your card, Paystack charges that card again every month until you stop it. You can stop automatic renewal at any time on the Plan and billing page. Your plan then keeps working until the end of the month you paid for. A one-month payment by card, bank transfer or USSD does not renew.
• Video minutes. Each plan includes a number of video minutes each month. Minutes are used when you start writing a script for a new video and are counted by the length you chose (a short counts as at least 1 minute). If the script cannot be written at all, the minutes are returned. Minutes you do not use do not carry over to the next month.
• Narration allowance. Each video has a narration allowance based on its length, which leaves room to re-record. Once it is used up, you can start a new video or upgrade.
• Switching plans. A new plan starts on the day you pay, with its own full minutes. Unused minutes and days of the old plan do not carry over, and we cancel the old card subscription so you are not charged twice.
• When a plan ends. Videos saved on your device stay on your device, and you can still open, edit and export them. You cannot start new videos or use the AI features until you renew.
• Payments. Payments are processed by Paystack. We do not see or store your card details. Taxes may apply.
• Fair use. Plans are for your own use. We may limit the speed or number of requests to protect the Service for everyone.
• Changes. We may change prices or plans with reasonable notice. A change will not affect a period you have already paid for.
• Refunds. Our Refund and Cancellation Policy explains when we refund a payment.

Using the Service properly

You agree to follow the Acceptable Use Policy. In short: do not break the law, harm others, deceive people, infringe rights, or abuse or attack the Service.

Other companies’ services

The Service works with services from other companies, such as AI providers, Google sign-in, payments and video platforms. Their terms and policies apply to their services, and they may change or stop their services, which can affect the Service. We are not responsible for other companies’ services.

Our rights

The Service, including its design, software, brand and text, belongs to us or our licensors and is protected by law. We give you a personal, limited, non-exclusive, non-transferable right to use it under these Terms. You may not copy it, reverse engineer it, resell it or use it to build a competing service. If you send us feedback, we may use it without owing you anything.

Suspension and ending

You can stop using the Service and ask us to close your account at any time. We may suspend or close an account, with notice where reasonable, if you break these Terms, create risk or harm for others or for us, or if the law requires. Parts of these Terms that should continue after your account ends, such as limits on our liability, will continue.

No promises beyond the law

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we do not promise that it will be uninterrupted, error-free or suitable for your particular purpose, or that your videos will be accepted by any platform or earn any views or money.

Limits on our responsibility

To the fullest extent the law allows, we are not liable for indirect or consequential losses, lost profits, lost data or lost opportunities, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim (or a small fixed amount if you paid nothing). Nothing in these Terms limits liability that cannot be limited by law, such as for fraud.

If your content causes a claim

You agree to cover reasonable costs and losses we suffer if a third party makes a claim because of Your Content or because you broke these Terms or the law.

Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Please contact us first at createwoksapp@gmail.com so we can try to fix a problem informally. If we cannot, the courts of that country will have jurisdiction, unless the law gives you the right to go to court where you live.

Changes to these Terms

We may update these Terms. The date at the top shows the latest version. If a change is important we will tell you in the app or by email, and we may ask you to agree again. Using the Service after a change means you accept it.

General

If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. These Terms, with the policies they mention, are the whole agreement between you and us about the Service.
